Section 504 of the Rehabilitation Act and the Americans with Disabilities Act

We are here to ensure that, "No otherwise qualified individual with a disability shall solely by reason of her or his disability be excluded from the participation in, be denied the benefits of or be subjected to discrimination under any program or activity receiving federal financial assistance."

Section 504 of the Rehabilitation Act of 1973 (Section 504) as amended, is a civil rights statute which prohibits discrimination against individuals with disabilities as defined in Section 504 and the Americans with Disabilities Act (ADA).  Section 504 is enforced by the Office for Civil Rights (OCR).  OCR also enforces Title II of the ADA,  which was reauthorized as the ADAAA of 2008 and which extends this prohibition against discrimination to the full range of state and local government services (including public schools), programs, or activities regardless of whether they receive federal funding.  Therefore, Section 504 is now part of the ADAAA and enforced as such.

Charlotte-Mecklenburg Schools (CMS) shall not discriminate on the basis of sex in any of its educational programs or activities. The Title IX Coordinator shall serve as the Title IX officer for the District.

The Title IX Coordinator’s duties include, but are not be limited to, coordinating the District’s efforts to comply with and carry out its responsibilities under Title IX and to carry out an investigation of any grievance communicated to the District alleging noncompliance with Title IX or alleging any actions which would be prohibited by Title IX in accordance with the procedures set forth hereinafter. The Title IX Coordinator may be assisted by other personnel as needed, including but not limited to personnel in the District’s Human Resources department.

In accordance with Federal civil rights law and U.S. Department of Agriculture (USDA) civil rights regulations and policies, Charlotte-Mecklenburg Schools is prohibited from discriminating on the basis of race, color, national origin, sex (including gender identity and sexual orientation), disability, age, or reprisal or retaliation for prior civil rights activity.

Program information may be made available in languages other than English. Persons with disabilities who require alternative means of communication to obtain program information (e.g., Braille, large print, audiotape, American Sign Language), should contact the responsible state or local agency that administers the program or USDA's TARGET Center at (202) 720-2600 (voice and TTY) or contact USDA through the Federal Relay Service at (800) 877-8339.

To file a program discrimination complaint, a Complainant should complete a Form AD-3027, USDA Program Discrimination Complaint Form which can be obtained online, from any USDA office, by calling (866) 632-9992, or by writing a letter addressed to USDA. The letter must contain the complainant's name, address, telephone number, and a written description of the alleged discriminatory action in sufficient detail to inform the Assistant Secretary for Civil Rights (ASCR) about the nature and date of an alleged civil rights violation. The completed AD-3027 form or letter must be submitted to USDA by:
